Badi Plight

A couple of days ago, more than a hundred badi protestors agitating in front of the parliament were arrested by security personnel. A few of them were also injured when the police baton-charged to disperse the agitating protestors.

Earlier, the badis picketed the residence of prime Minster Girija Prasad Koirala while the male and female badis protested semi-nude around Maitighar and Singha Durbar respectively, pressing the government to fulfill their 20 point demand that includes, among others, two seats for the badi community in the Constituent Assembly (CA) and farm lands for alternate means of living. The badis, who originally hail from Western Nepal , have come a long way with hopes of emancipation from the sex trade. At this juncture, it is foolish to overlook their plight and accuse them of being incited by a bunch of non-governmental organization.

Every citizen has the right to a dignified living in a democratic state. And, it is the responsibility of the government to address the basic needs of minorities and disadvantage communities, and guarantee them a dignified living. Traditionally recognized as commercial sex workers, the badis are one of the most disadvantaged, exploited and [neglected] ethnic communities. In badi community, husbands are [forced to] push their wives and daughters in to the vortex sex trade to make a living. The majority of badi women have no idea of safe sex. There are reports that having sex with multiple partners has infected the badi women with different sexual Transmitted Disease (STD), including HIV/AIDS. [When] the disadvantaged groups such the badi community send their political representatives in the CA, it will began a process of reintegrating the community into the political mainstream.

It is a matter of national shame that the badis, who came to the capital from different districts, were forced to stage a semi-nude protest in front of Singh Durbar to draw the government’s attention towards their plight. The semi-nude protest has eroded the country’s image and exhibited the government’ indifferent attitude towards the plight of backward communities. It is high time the government considered the plight of the disadvantaged communities, including the badis and the deukis engaged in sex trade. It is also a good gesture that the badis have chosen a peaceful means to make their demands heard. It would be wise on the part of the government to address the 20-point demands of the badi community and come to an agreement with them. Let us hope the government pays due heed to ensure the rights of the badi community before the things get out of control.

नेपाल दलित संघ केन्द्रीय तदर्थ कार्यसमिति गठन (Ad-hoc Central Executive Committee of Nepal Dalit Sangh Formed)

Kathmandu, August 29- Nepali Congress Party has formed an ad-hoc Central Executive Committee of Nepal Dalit Sangh with Khadga Bahadur Basyal (Sarki) and Jeevan Pariyar as the President and General Secretary respectively, and five Vice-Presidents. The total strength of the Committee representing various districts of Nepal has 39 members, whose names are listed in a press statement released by the party (read below).

Nepal Dalit Sangh is the Dalit wing organization of Nepali Congress, the largest political party of Nepal. Prof. Man Bahadur Bishwakarma, who was the Minister of Science & Technology and Environment during the first leg of the current interim government before Maoists joined the government, represents Dalit community in the Central Committee of Nepali Congress.

Police arrests of Dalit rights defenders continue

KATHMANDU, Aug 27 - Police arrests of Dalit rights defenders staging peaceful demonstrations continue in Kathmandu. Resorting to baton-charge this morning, the police arrested over 50 activists from Badi Rights Struggle Committee (BDRSC) and Dalit Citizen Movement (DCM) and other Dalit rights defenders in front of south gate of Singh Dubar. The details of the incident is cited in the press release from Dalit Citizen Movement Central Coordination Committee, (given below, in Nepali), deploring the arrests.

“In a separate statement released, Human Rights Treaty Monitoring Coordination Committee (HRTMCC) has denounced the police action against human rights defenders and agitating demonstrators. The HRMTCC alleged that the arrested were beaten up even after they were put into police vans.”, reports eKantipur.com.

“Dalit Civil Society Movement’s Binod Pahadi and coordinator of Badi Community Struggle Committee Uma Devi Badi were among those arrested. They have all been kept at the Armed Police Force (AFP) no.2 batallion in Maharajgunj.” reports nepalnews.com.

The BCSC and DCM have been organizing various demonstration programs in the capital city for the last few weeks demanding that the government ensure 20 percent seats for the Dalit community in the Constituent Assembly (CA) election and proper rehabilitation for the Badi community.

राज्यका हरेक क्षेत्रबाट पाखा लगाईका दलितहरु विगत लामो समयदेखि सडक संर्घष्ामा छन् । मान्छे भएर पनि मान्छेको जस्तो व्यवहार नपाउनु, राज्यद्धारा जहिले पनि दलित अधिकारको सवाललाई गंभीरतापर्ुवक नलिनुले दलितहरुलाई आक्रान्त पारेको छ । सवै खालका सामन्तवादको अन्त्यका लागि दलितहरुले लोकतान्त्रिक आन्दोलनमा अग्रणी भुमिका खेलेता पनि राज्य दलित अधिकारको पक्षमा कहिल्यै देखिएन । जतिपनि दलित पक्षिय कुराहरु उठे ति केवल राजनैतिक पार्टर्ीी गुलिया नारामात्र वन्न पुग्यो । दलितहरु सधैं राजनैतिक पार्टर्ीी गुलिया नाराको पछि मात्र कति लाग्ने भन्ने प्रश्न उठिरहेको वेला विगत केही समयदेखि दलित नागरिक आन्दोलन सडक संर्घष्ामा छ । दलित नागरिक आन्दोलनको तर्फाट केही चरणवद्ध र शान्तिपर्ुण्ा संर्घष्ाका कार्यक्रमहरु अघि वढाउँदा राज्यले दलितहरुको माग र आवाजलाई सुन्नुको सटटा प्रहरी लगाएर लगातार हस्तक्षेप गर्दै आएको छ । राज्यको त्यसप्रकारको नियतप्रति हामी घोर भर्त्सना गर्दछौं ।

For making the 1000 statues, Manjul will need around 2.5 million Nepalese rupees (approximately 39-40 thousand US dollars). But even now he is facing more than monetary problems. He has no place to store the 60 statues that have already been prepared till now. Manjul Baraili and Kausila Rai, who are residing temporarily at Urlabari (50 km away from Biratnagar) hope to submit their statues to the Government of Nepal upon completion. The Dalit couple is committed to sculpt 1000 half-sized statues of historical figures from around the world.

Originally hailing from Tadhi- Morang, Manjul has resided at Urlabari since 7 years, running the local Miteri Art Center. He was attracted towards idol-making after reading the biography of Aruniko, a historical artist of Nepal. In the past, he has prepared idols of the 24 persons who died in a helicopter crash at Taplejung on request of Federation of Nepalese Journalists.

He requested members of his local government to help him find a storage location. But till now, they have given him a deaf ear. He asked for a place to keep the statues in the Urlabari VDC, but the VDC too gave deaf ear.

It takes nearly three months to prepare a half-sized statue, even with the help of his wife and sister. Due to his reputation and experience, which included a 2-year long statue-making training in Patan, Manjul gets separate order of making idols of Hindu deities.

He is largely supported by an individual patron, Mark Brithav of the United States. Despite the limited financial support, Manjul needs a safe place to put his works. He is planning to ask the local Village Development Committee for a workshop.

Historical context of Dalits in Nepal

The State formalized the caste system throughout Nepal during the reign of King Surendra Bikram Shah when Jung Bahadur Rana, founder of the Rana rule, promulgated the Muluki Ain (Country Code) in 1854. This Code, the first proclamation of State authority on all matters concerning the social and religious rights of individuals,20 organized Nepalese caste and ethnic groups into four categories: i. Tagadhari (caste wearing the holy thread); ii. Matwali (nonenslaveable alcohol-drinkers); iii. Pani nachalne-chhoi chhitto halnu naparne (castes from whom water is not accepted, but whose touch does not require sprinkling of water for purification); and iv. Pani nachalne-chhoi chhitto halnu parne (from whom water is not accepted and whose touch requires purification by sprinkling water).

The Country Code thus reconstructed Nepalese social structure into a four-fold caste hierarchy and placed Dalits – the groups belonging to the fourth category, at the bottom. Before the implementation of the law, the indigenous nationalities had an egalitarian social structure and were outside the four-fold Varna and Hindu caste system.21 As the Code was the first law applicable throughout the country, the practice of untouchability became universalized. The Code also divided Dalits themselves hierarchically. This compelled Dalits to practice untouchability and discriminate against those who ranked below them within the broad group of untouchables.

Although the country later witnessed significant political turmoil, including the overthrow of the Rana regime in 1950 and the establishment of politically egalitarian governance in 1958, the Country Code of 1854 remained in force with only moderate informal adjustments until 1963, when the Naya Muluki Ain (New Country Code) was enforced under the Panchayat System. This New Code marks the beginning of a new era of the most radical changes in Nepal because it stated that legally all citizens are equal irrespective of caste, creed and sex. The Muluki Ain of 1963 also abolished discrimination between castes in respect of capital punishment. However, it did not declare the practice of untouchability punishable. The restoration of democracy in 1990 intensified the voices of subjugated groups. The new Constitution of 1990 reiterates the universality of human rights, equality among Nepalese citizens in respect of rights and responsibilities, and also declares discrimination on the basis of caste punishable. Despite the reform measures introduced during the last four decades, little has changed in Nepal’s social structures, norms and practices, including the attitudes and behaviours of non-Dalits towards Dalits – or among Dalits themselves.

15 points declaration by Dalit Civil Society Organizations in Pokhara

Kathmandu, August 26- Dalit Civil Society Organizations and UNDP/CASU organized a Regional Conference Pokhara on “Dalit Participation in State Restructuring and Constituent Assembly” that was held on 23-24 August 2007 in the Western Region. The program was aimed at finding out Regional common issues of Dalits to be addressed in the forthcoming Constituent Assembly and State Restructuring process. The similar two regional conferences in Janakpur and Dang which are located at Mid-Central and Mid-Western Regions respectively have already been organized. Altogether six conferences have been scheduled to be organized all over the country, including five regional and one national to find out issues and agenda of Dalits for Constituent Assembly.

Based on in-depth discussion on the regional common issues of Dalits in the conference, a 15-point Dalits’ declaration has been announced by Dalit Civil Society Organizations at the end of the program.

The major points of declaration include following demands to be addressed in the State restructuring process and Constituent Assembly.

• Proportional representation of Dalits based on their population size in the CA Polls.
• Demand for proportional electoral system to be adopted by the sate.
• Guarantee of alternative employment by abolishing existing social evils, Bali hare (Payment in kind/crops for services) and Carcass systems.
• Guarantee of 20% reservation in each organ of the State
• Stop immediately all types of violence, discrimination and sexual exploitation.
• Demand for especial facilities to the excluded and deprived Dalit family within Dalit community in the sectors of health treatment, transportation, and consumable goods by making provision of 25% discount based on the Card system on above stated facilities by the state.
• Demand for appointment of one male and female teacher in each school.
• Demand for free and compulsory education with apt scholarship to all Dalit students from primary to university levels.
• Demand for changing feudalistic attitude and conservative thinking being followed for centuries.

Kathmandu, August 26- The Nepal government has recently constituted the National Women’s Commission under the chairpersonship of Nianakala Thapa of Chitawan. Dhana Kumari Sunar of Makawanpur is appointed as member from Dalit community. Other members appointed in the commission are Ratna Sherchan of Baglung, Amoda Shrestha of Kathmandu and Manju Kumari Yadav Chaudhari of Dhanusa respectively according to the Ministry of Women, Children and Social Welfare.

The United Republican Dalit Front issues a 7-day ultimatum to Nepal Government

The United Republican Dalit Front has issued a seven-day ultimatum to the government of Nepal upon successful completion of the first phase of the protest programs spear headed by the Front for getting 10-point basic demands of Nepali Dalit community fulfilled.

The ultimatum has come up when the process of preliminary talks has began between Nepal government and various groups of Dalit organizations. “This has been a welcome step. However, the process of talks will be important only when the demands are addressed and decisively met. Towards that direction, the government’s attitude has not been encouraging so far. In the present context of approaching sensitive juncture in the national politics, we are intensifying the process of dialogue by giving a seven-day ultimatum to the government. The ultimatum issued to the government (in Nepali) follows:

बिषय ः सात दिने अल्टिमेटम ।

महोदय,

विगत २३९ बर्षो हिन्दू सामन्ती-व्राह्मणवादी राजतन्त्रात्मक राजनैतिक, आर्थिक तथा सा“स्कृतिक संरचनाका बिरुद्ध चल्दै आएका नेपाली जनताको संर्घष्ाको उत्कर्ष२०६२/६३ को जनआन्दोलन र दश बर्षो जनयुद्धपश्चात् नेपाली जनताको भाग्यको फैसला गर्ने दिशामा अन्तरिम संविधान निर्माण एवं दर्ुइ/दर्ुइ पटकको संशोधनको प्रक्रियामा समाजको पींधमा रहेका नेपाली दलित समुदायका आधारभूत माग र आकांक्षालाई न्यायपर्ूण्ा ढंगले सम्बोधन गर्न सालिनतापर्ूवक गरिएका अनुरोध-आग्रहलाई उपेक्षा गरिएकाले बाध्य भएर हामी आन्दोलित भएको यथार्थ अवगत नै छ । त्यसक्रममा विगत श्रावण ९ गतेदेखि देशव्यापी अन्तरक्रिया, देशव्यापी जनपर््रदर्शन, मसाल जुलुश हु“दै भाद्र १ गते चितवन बन्द र भाद्र ५ गते काठमाण्डौं उपत्यका बन्द लगायतका कार्यक्रममार्फ सरकारलाई हाम्रो आक्रोशित मनस्थिति अवगत गराइसकेका छौं । हामी चाहन्छौं, दलित समुदायका माग र आकांक्षालाई समयमै सही सम्बोधन होस् र निर्धारित मितिमै संविधानसभाको निर्वाचन सम्पन्न होस् । त्यस सर्न्दर्भमा नेपाल सरकारले हामी सहित देशका विभिन्न दलित संगठनहरूस“ग गत श्रावण ३२ गते प्रारम्भिक वार्ता प्रक्रिया शुरु गर्नुलाई हामीले स्वागत योग्य नै ठानेका छौं तर वार्ता प्रक्रियालाई निश्कर्षा लैजान सरकारले उत्साह नदेखाएकोमा हामी अचम्मित छौं ।

हामी नेपाली दलित समुदायका मागलाई पुरा गराउन आन्दोलनमा उत्रिसकेकाले खाली हात फर्किन सक्दैनौं । साथै हाम्रा आन्दोलन फगत कुनै खास पार्टर्ीीा राजनैतिक समुहको निहित स्वार्थ पर्ूर्तिका निम्ति होइन । बरु, सम्पर्ूण्ा दलितको साझा आकांक्षाको प्रतिध्वनि हो भन्ने यथार्थ पनि नेपाल सरकारलाई जानकारी भैसकेको छ भनि हामी ठान्दछौं ।

यस स्थितिमा समग्र राष्ट्रिय राजनीतिको जटिलतालाई मध्यनजर राखि दोश्रो चरणको आन्दोलनको कार्यक्रम घोषणा गर्नुभन्दा पहिले सरकारको गम्भीर ध्यानाकार्षा गराउन तपार्“इमार्फ यो अल्टिमेटम-पत्र प्रस्तुत गरेका छौं । हामी चाहन्छौं- आगामी सात दिन भित्र वार्ता प्रक्रियामार्फ ठोस रुपमा हाम्रा मागलाई सम्बोधन गरियोस् । अन्यथा, दोश्रो चरणको आन्दोलनमा जान हामी बाध्य हुनेछौं र त्यसबाट राष्ट्रिय राजनीतिमा उत्पन्न हुने जस्तोसुकै परिस्थितिको जिम्मेवार हामी हैन, बरु नेपाल सरकार नै हुनेछ, धन्यवाद ।

प्रेस विज्ञप्ति

मुलुकको संवैधानिक तहदेखि नै मानविय अधिकारहरुको पूर्ण स्थापना तथा व्यवहारिक हुनु देशका लागि सवल मेरुदण्डिय संरचनाको उच्च कदर हुनु हो । कुनै पनि ब्यक्ति, वर्ग विषेशको रंग्, जातियता वा अल्पसंख्यक बहुसंख्यक को आधारखडा गराई तिनिहरुको वेवस्ता गरिनु भन्ने त देशको रुग्ण - अप्रजातान्त्रिक शासन प्रणालिको प्रदर्शन गर्नु हो । अहिलेको सरकार आफ्नो त्यही असक्षमता प्रदर्शन गर्न उद्रित भएको छ ।

केहि दिन अगाडि मात्र पिछडिएका, उत्पिडित एवं मानविय अधिकारहरुबाट बंचित पारिएका दलितहरुद्वारा गरिएको शान्तिपूर्ण प्रदर्शनको छाप बिर्सन नपाउदै हिजो मात्र सम्पूर्ण उपत्यकावासीहरुको अपार समर्थन पाई सफल उपत्यका बन्द कार्यक्रमका दौरान फेरि सरकारले प्रहरी दमन तथा हस्तक्षेप गरेको समाचारले हाम्रो ध्यानाकर्षण गरेको छ । यसै क्रममा वादी समुहहरुले आफ्नो स-समान हक र अधिकारहरुको पूर्ण स्थापनार्थ गरेको प्रदर्शन सरकारी अति-बेवास्ताले उब्जाएको सरकार स्वयमकै रुप भएको भन्ने ठहर गर्दै उपत्यका बन्द र वादी समुह हरुद्वारा गरिएको शान्तिपूर्ण प्रदर्शनका दौरान भएको हस्तक्षेप र गिरफ्तारीको यस नासो कम्युनिटी घोर भर्त्सना एवं निन्दा गर्दछ ।

मानविय अधिकारका मुल्य मान्यताहरुको स्थापनार्थ सबै मागहरु पुरा गर्दै गिरफ्तार गरिएका सम्पूर्ण मानव अधिकार कर्मिहरुको रिहा एवं उचित औषधोपचार गर्न समेत यस नासो कम्युनिटी आव्हान गर्दछ।
