Paswan vows to shoulder Dalit woes



Newly appointed Minister for Land Reform and Management Mahendra Paswan vowed on Monday that he would walk away from the government and join Dalits for yet another movement if Dalit rights were not guaranteed in the new constitution.

KATHMANDU, March 31 - Newly appointed Minister for Land Reform and Management Mahendra Paswan vowed on Monday that he would walk away from the government and join Dalits for yet another movement if Dalit rights were not guaranteed in the new constitution.

Speaking at a programme organised by National Dalit Commission (NDC) to discuss recommendations for the new statute, Paswan said he would strive to compensate the losses Dalits had so far incurred due to years of suppression. “Dalits should get their stakes this time around so as to fully compensate their losses in the past even if such a move demands holding back certain stakes belonging to privileged groups,” he said.
Responding to the recommendations up for discussion at the programme, Paswan said he would make special efforts to ensure that genuine concerns were incorporated in the new constitution.

Yam Bahadur Kishan floated the NDC’s draft recommendations, which urges the Constituent Assembly to guarantee a whole list of Dalit rights including right to education, employment, access to basic health facilities, protection against caste-based discrimination, unsociability and others.

Among others, the report also urges the government to adopt a fully proportional electoral system in all future elections and guarantee proportional representation of Dalit and other excluded groups in the judiciary and other constitutional bodies, including the Supreme Court and Judicial Council.

NDC Chairman Ram Lal Bishwokarma said NDC would soon submit its recommendations incorporating feedbacks received from all quarters.

Three commissions to work together in witchcraft case

KATHMANDU, March 27- National Human Rights Commission, National Women Commission and National Dalit Commission have decided to work together on the issue of witchcraft abuse in Pyutar, Lalitpur.

Representatives of the three commissions met at NHRC premises Monday afternoon to discuss the incident that occurred last week.

The three commissions also discussed about taking action against the perpetrator and provide compensation as well as security to the victim.

The meeting also agreed the incident was against international protocols on human rights of which Nepal was a signatory and also against the interim constitution of Nepal.

One Kali Kumari BK and her husband Chet Bahadur had been rescued from Lalitpur last week by a team of representatives from National Dalit Commission, National Women’s Commission, Human Rights Organisations, journalists and a Dalit CA member.

BK was allegedly tortured by villagers in allegation of practicing witchcraft. BK said she was beaten up, abused and even made to eat human excreta by a group of people in the village.

सभासदहरु विनोद पहाडी धर्मशिला चापागाई सन्तबहादुर नेपाली खड्ग बस्याल नेकपा एमालेका केन्द्रीय सदस्य जीतु गौतम लगायतका व्यक्तिहरुले घटना घटेको १० दिनसम्म र नागरिक समाज पत्रकारहरु दलित कार्यकताहरुले घटनास्थलमा पुगि घटनास्थलमा रहेको प्रहरी टोलीलाई पिडक विमला लामालाई जिम्मा लगाई गत १२ गते घटनास्थलबाट काठमाडौ प्रवेश गरेको थियो । तर अहिले आएर दोषी भाग्यो भनेर भन्नु लज्जास्पद र नियोजित भएको भन्दै प्रमुख जिल्ला अधिकारीको आलोचना गर्नु भएको थियो ।

ललितपुर प्युटारमा घटेको घटनाको विरुद्ध भोली बिहान १० बजे देखि १ बजे सम्म ललितपुर जिल्ला प्रशासन कार्यालय घेराउ र ताला बन्दी गर्ने कार्यक्रम प्युटार घटना न्यायिक दवाव समितिले गरेको छ । आज भन्दा ७८ घण्टा अगाडि जिल्ला प्रमुख अधिकारी लक्ष्मीप्रसाद ढकाललाई दोषीलाई पकि्र कारवाही गर्नको लागि २४ घण्टे अल्टीमेटम दिएको तर आज सम्म पनि घटनाको दोषीलाई पक्रन कुनै पहल नगरेकोले अब आजसम्ममा दोषीलाई पक्री कारवाही अगाडी नबडाएमा चरण बद्ध सडक आन्दोलन गर्ने चेतावनी समितिले दिएको छ ।

Finally Dalits Get a Cabinet Seat: Mahendra Paswan Named Minister for Land Reform

KATHMANDU, March 25- The Cabinet meeting today named Mahendra Paswan as the Minister for Land Reform and Management in the present coalition Government of Nepal. Dalits have been demanding their fair share of representation in the Cabinet ever since the CA election. Last Saturday speaking to Dalit communities, the Prime Minister Prachanda had promised for naming one cabinet minister and one assistant minister from Dalit communities within a week’s time. Paswan will be taking the cabinet portfolio that was held by Prime Minister since Matrika Yadav resigned from the post.

The Nepaldalitinfo expresses hearty congratulations to Minister Paswan and hopes that he will make a strong Dalit presence in the cabinet.

Minister designate Paswan was elected to the CA from Siraha Constituency No.5 under the First-Past-the-Post (direct) electoral system, and represents Madhesi Dalits. Paswan has made commitment to CA saying that he will play a role in writing a constitution that is in favour of those groups of people who are backward just because they belong to certain regions and castes.

Paswan was born on September 5, 1974 in Jayapur of Majhauliya in Siraha district. He comes from a poor family, and had to earn a living by ploughing land and rearing cows for others. Known by the nickname ‘Arvinda’ within the United CPN (Maoists), Paswan got involved in politics since 1988. He has worked in many Terai districts. He served also in-charge of Bara, Parsa, Udayapur, Makwanpur and Lalitpur districts in his party.

Paswan, holds a Bachelor’s degree in Law. He was coordinator of Madhesi Mukti Morcha (Madhesi Liberation Front) formed in 2000 in Siligudhi, India. Jay Krishna Goit and Matrika Yadav were presidents of the Front. Paswan has also been among the 95 central members of the CPN (Maoist). Agitated by untouchability and caste-based discrimination, now Paswan is secretary of the Mithila-Bhojapura State Committee.

Paswan’s wife, Sanjita, is a leader of All Nepal Women’s Association, a sister organization of the United CPN (Maoists).

दक्षिण अपि्रुकाको सार्पभिल्लेमा रंगभेदी कानुनको विरुद्ध भएको एक शान्तिपूर्ण प्रदर्शनमाथि प्रहरीले गोली चलाउँदा ६९ जना अधिकारकर्मी मारिएको स्मरण गर्दै २१ मार्चको दिन नेपालमा पनि ४४ औं अन्तर्राष्ट्रिय जातिभेद उन्मूलन दिवस मनाइयो ।

सन् २००२ मार्च २१ अर्थात ३७ औं अन्तर्राष्ट्रिय जातिभेद उन्मूलन दिवसको अवर पारेर तत्कालिन मन्त्रीपरिषदले स्थापना गरेको राष्ट्रिय दलित आयोगको ७ औं वार्षिकोत्सव तथा ४४ औं अन्तर्राष्ट्रिय जातिभेद उन्मूलन दिवसको अवसरमा प्रधानमन्त्री पुष्पकमल दाहाल प्रचण्डले एक हप्ता भित्र एक पूर्ण मन्त्री र एक सहायक मन्त्री बनाएर मन्त्री परिषदमा दलित समुदायको प्रतिनिधत्वको सुनिश्चितता गर्ने बताउनु भयो । दलितको रक्तसाचारको आन्दोलनबाट म नेतृत्वमा आएको हुँ । मैले यो कहिल्यै बिसर्िदैन भन्दै दलित आन्दोलनमा सदैव सहयोगर प्रतिबघद्धता रहने बताउनु भयो ।

उक्त कार्यक्रममा बोल्दै राष्ट्रिय दलित आयोगका अध्यक्ष रामलाल विश्वकर्माले दलित समुदायष्का मागलाई मा राजनीतिक दलले घोषणा पत्र साथै सरकारी कागजी दस्तावेजको रुपमा राखेर समस्या समाधान नहुने बताउनु भयो । यसका लागि उहाँले व्यवहारिक रुपमा कार्यान्वयन हुनु पर्नेमा जोड दिनु भयो । सोही कार्यक्रममा राष्ट्रिय दलित आयोगले गरेका कार्यक्रमहरुको प्रगति प्रतिवेदन अध्यक्ष विश्वकर्माले प्रधानमन्त्री प्रचण्डलाई हस्ताण्तरण गर्नु भयो ।

APEAL अपिल पत्र: “सम्मान र न्याय जातीय बिभेद विरुद्धको आधारशिला” ४४ औं अन्तर्राष्ट्रिय जातिभेद उन्मूलन दिवस

२१ मार्च २००९-
सन् १९६० मार्च २१ का दिन दक्षिण अपि्रुकाको सार्पभिल्लेमा रगंभेदी कानुनविरुद्ध भएको एक शान्तिपूर्ण प्रदर्शनमाथि प्रहरीले गोली चलाउँदा ६९ जना अधिकारकर्मीहरु मारिए भने ३०० भन्दा बढीलाई घाईते बनायो । सो दुःखान्त घटनाको स्मरण गर्दै राष्ट्रसंघको महासभाले सन् १९६६ मा मार्च २१ तारिखलाई रंगभेद उन्मुलनको अन्तर्राष्ट्रिय दिवसकोरुपमा घोषणा गर्यो । तदनुरुप सो दिनलाई विश्वमा रंगभेद दिवसकोरुपमा मनाउदैं आएतापनि नेपालमा भने यसलाई जातिभेद दिवसकोरुपमा मनाउँदै आईएको छ ।

समानता र स्वतन्त्रतापूर्वक बाच्न पाउनु हरेक नागरिकको नैसर्गिक अधिकार हो । कसैले कसैलाई जात धर्म लिङ्ग पेशा भाषा क्षेत्रको आधारमा भेदभाव गर्न हुदैन र पाईदैन भन्ने कानूनी र विश्वब्यापी मान्यता भईसकेको छ । यद्यपि नेपालमा दलित समुदाय वर्षौदेखि जातीय-विभेदकॊ पीडा सहनु परिरहेकै छ जुन भेदभाव मानवअधिकारको चरम उलंघन समेत हो ।

मुलुक संघीय लोकतान्त्रिक गणतन्त्रमा गई नयाँ संविधान निर्माण प्रकृयामा छ र अव बन्ने नयाँ संविधानले समानुपातिक प्रतिनिधित्व सहितको संघीय समावेशी लोकतान्त्रिक गणतन्त्र एवं विभेदरहित समाजको नै अवको भावी नेपालको साँस्कृतिक स्वरुप हो । त्यसैगरी विभिन्न अधिकारमुखी आन्दोलनले दलित महिला जनजाति मुश्लिम थारु मधेशी पिछडिएको क्षेत्र आदिलाई राज्यको हरेक तहमा प्रतिनिधित्व गराउन निर्देशसमेत गरिसकेको छ । तथापि राज्य र राजनैतिक दल तथा विभिन्न संघसंस्थाहरु दलित समुदायलाई सो निर्देशन अनुरुप समावेश गराउन हिचकिचाईरहेका छन् भने अपेक्षाकृतरुपमा दलितका सवालहरुलाई संवोधन गर्न मानिरहेका छैनन् । फलतः नीति निर्माण र राज्यको निर्णायक निकायहरुमा दलितको प्रतिनिधित्व छैन नै भनेपनि हुन्छ ।

अतः दलित समुदायको राज्यको हरेक क्षेत्रमा समानुपातिक प्रतिनिधित्वको सुनिश्चितता तथा जातीय-विभेद पूर्ण उन्मुलन गर्न निर्मित कानुनहरुको ईमान्दारिताकासाथ कार्यन्वयन होस् र मानवअधिकार एवं सामाजिक न्यायको सुनिश्चितता होस् भन्नेमा यस ४४ औं अन्तर्राष्ट्रिय जातिभेद उन्मूलन दिवस २१ मार्च मुल आयोजक समिति हार्दिक अपिल गर्दछ ।

दलित समुदायका साझा सवाल:

-राज्यको सबै निकायको हरेक तहमा दलित समुदायको २० प्रतिशत प्रतिनिधित्वको सुनिश्चित गरियोस्
-संघीय स्वरुप अनुसारको संवैधानिक आरक्षणको व्यवस्था गरियोस् ।
-दलित समुदायका सुकुम्वासी तथा भूमिहिन समस्याको समाधान गर्दै हलियाहरुलाई न्यायोचित भूमीको वितरण र तिनको पुनस्रथापनाको व्यवस्था गरियोस् ।
-राष्ट्रिय दलित आयेागलाई सर्वाधिकार सम्पन्न संवैधानिक बनाइ जातीय छुवाछूत तथा भेदभावबिरुद्ध छुट्टै र प्रभावकारी ऐन कानूनको तर्जुमा गरी प्रभावकारी कार्यान्वयन गरियोस् ।
-अवको दशकलाई विशेष कार्ययोजनासहितको दलित अधिकार एवं विकास दशकको रुपमा घोषणा गरियोस् ।
-छुवाछुतको मुद्धा हेर्ने छुट्टै बिशेष अदालत गठन गरियोस् ।
-दलित समुदायलाई राजनितिक दलहरुको सबै तहमा २० प्रतिशत प्रतिनिधित्वको सुनिश्चित गरियोस् । -२१ मार्चलाई जातिभेद उन्मुलन दिवसकोरुपमा घोषणा गरी राष्ट्रिय रुपमा सार्वजानिक विदा दिईयोस् ।
-महिलाहरुलाई छुट्टाईएको ३३ प्रतिशत आरक्षणमध्ये त्यसको २० प्रतिशत दलित महिलालाई छुट्ट्याईयोस् ।

Stimulate Law to Ban Untouchability- Navi Pillay says

LONDON, 22 March, 2009- The Office of High Commissioner for Human Rights (OHCHR) Chief has advised Nepal to stimulate existing laws to ban untouchability and enforce accountability to those who commit human rights violations. UN Higher Commissioner for Human Rights Ms. Navanethem Pillay, during her 5 day visit to Nepal, expressed support on ‘significant steps’ already taken against the caste based discrimination.

Talking to representatives of the civil society in Kathmandu, Navi Pillay stated discrimination as one of the major causes of conflict in Nepal, and those marginalized groups including women should essentially enjoy changes in their lives with an immediate access to justice when their human rights get violated- a Washington DC based organisation International Commission for Dalit Rights (ICDR)’s document post quoted.

Focusing post Comprehensive Peace Agreement progresses and consequences, she said, “The challenges that lie ahead remain as daunting as those that have been surmounted already.”

“Recognizing the need to consolidate the peace and to support those working for a ‘new Nepal’, we have refocused our programmes to address fundamental human rights issues that lay at the root of the conflict, and which regrettably continue today, especially discrimination, lack of access to social, economic and cultural rights and impunity,” Navi Pillay said.

Navi Pillay met President, Prime Minister and higher authorities in the Government of Nepal. She consulted with Civil Society members on human rights issues, and also visited local families of human rights victims.

UN Higher Commissioner’s visit also marked a special day against racial discrimination- International Day for the Elimination of Racial Discrimination, the 21st March.

During her visit in Janakpur on 21st March, Pillay underlined the present situation of impunity and lack of social security. One of the national onlines dainikee.com reported UN Higher Commissioner’s commitment of highest priority is to eliminate caste based discrimination in Nepal.

International Day for the Elimination of Racial Discrimination marked 43rd years of recognizing 69 lives sacrificed in South Africa in what was a peaceful demonstration by Blacks but had brutal ending. Almost half a decade after this unpleasant incident, UN declared 21st March as a special day to commemorate all sacrifices made against racial discrimination. Nepal has been commemorating this day in various forms annually. Yet, not a single day out of a month or more of national days in the country is exclusively dedicated to the sacrifices made by thousands of Dalit lives in caste-based discrimination prevailing for hundreds of years in the country’s history.

Commemorating the International Day for the Elimination of Racial Discrimination: Stop Discrimination from the Heart and Mind !

Stop all the discriminatory instincts from the heart and mind to commemorate this year’s International Day for the Elimination of Racial Discrimination!

Earlier this week, when US President Barack Obama was sitting in a comic couch (the first ever event for a sitting US Prez) and was telling Jay Leno in his Late Night TV Show (NBC’s “Tonigtht Show with Jay Leno” to be precise) how he was doing with his sports at the White House, he slipped his tongue to make an ill-judged blunder comparing his sports (bowling and basket ball) with Special Olympics. Soon, he realized his serious mistake, and called the President of International Special Olympics expressing his due apology right from his Air Force One flight on his way back to the White House after videotaping of the show, that is, even before his words went out on air for the whole world to know as his blunder. What does this tell us? It simply tells us that humans are raised to develop their instincts to be discriminatory. Even the persons of best intent (or best caution at the least) could easily fall pray to their instincts. However, the systems in place, legal as well as social, against the discriminatory instincts can keep the people constantly warned from practicing such bad instincts.

In Nepal, the human instinct of practicing untouchability and caste discrimination is not only rampant but also deep rooted- that is, it is mixed in the people’s blood at high concentration. Nevertheless, this instinct does not originate from their genetic inheritance or by any accident; it comes from the social environment one is endowed with, right from her/her birth. When one expresses the highness of her or his caste (say Bahun or Newar), which is very common in every day life of so-called high caste people in Nepal, s/he is actually downgrading the people of other castes, especially so-called low castes. There are numerous proverbs in Nepali language, which are easily taken for granted as a part of cultural heritage, but only a few people may have realized that many of them are obnoxiously discriminatory based on so called ‘highness’ and ‘lowness’ of different castes. It is not the purpose of my writing here to highlight those discriminatory proverbs, but the readers may realize what those proverbs are at this treatise: Stop demeaning proverbs!

In Nepal as yet, there is neither a legal nor a social system in place to bar anyone to make discriminatory utterance out of her or his instincts that could hurt other people badly. In systematically curbing this behavioural instinct right from its bud, the Nepaldalitinfo International Network had been putting forward a demand to the State of Nepal, right from its inception in 2003 as the following:

Denounce and disband all expressions, proverbs, verbatim or written works, which promote hierarchical caste discrimination and untouchability in the society. Entrust [erstwhile Royal] Nepal Academy and Legal Book Management Authority with necessary directives to review and recommend corrections to all such official documents that take Dalits and other oppressed people for granted under the age-old caste discriminatory practices, and execute appropriate measures for making such corrections in the context of modern contemporary world.

In commemorating the International Day for the Elimination of Racial Discrimination this year, the founding Moderator of Nepaldalitinfo Dr. DP Rasali urges Nepali people to stop all the discriminatory instincts from their heart and mind, while the Government of Nepal must create a necessary state mechanism for a legal and social environment that disapproves the instincts that are unacceptable to human dignity of the 21st century.

As a backgrounder, on 21 March 1960, 69 Black demonstrators were killed at a peaceful protest against apartheid laws in South Africa. As a result, 21 March was declared “International Day for the Elimination of Racial Discrimination” by the UN in 1966.

An alliance of associations of Nepali marginalized communities formed in New York

Baltimore, Maryland (USAA)- NASO Community President Dharam Biswsakarm and Secretary Rajendra Kumar Senchuri participated in a meeting of various Nepali minority organizations held on March 6 in New York. The program was hosted by the Federation of Indigenous Peoples of Nepal in America (FIPNA), an alliance of 15 Janajati organizations. As Nepal is approaching the days to write a new constitution, various stakeholders felt the need to form alliance and therefore decided to bring different Nepali ethnic and minority groups together forming a coalition for advancing the marginalized people of Nepal. The whole purpose of such collaboration is to share different ideas to address the need and meet the aspiration of several marginalized communities like Dalit, Women, Adhivasis, Janajatis and Madhesis. Given the current situation of Nepal which is in a transitional phase and has been experiencing many conflicts among different deprived groups formation of such collaboration in US is pivotal. Furthermore, the antagonizing nature of different political speeches raises the question if the New Constitution will properly address the need of marginalized communities. The program which was chaired by the Vice-President of FIPNA Mr. Shiva Rai and conducted by Arjun Gurung saw the presence of various notable persons like Mr. Madhu Raman Acharya, Ambassador to UN from Nepal, Dr. Ashok Gurung, Director India China Institute, Mr. Anil Shahi (ADHRN), Ms. Luna Ranjit (Adhikar), Amit Shah (ANTA) and Krishna Rai.

So far there are five different founding groups/organizations in the Coalition whose stakeholders are looking forward to add many more organizations in the near future to be a part of the joint organization. The following are the five active member organizaitons of the alliance:

1. Adhikaar for Human Rights and Social Justice
2. Alliance for Democracy & Human Rights in Nepal (ADHRN)
3. Association of Nepali Tertian In America (ANTA)
4. Federation of Indigenous Peoples of Nepal In America (FIPNA, an alliance of 15 Janajati organizations)
5. Nepali-American Society for Oppressed Community (NASO)

Objectives of the coalition are highlighted as follows:

a. Provide a platform to foster a culture of peaceful dialog and constructive debates among people of differing opinions on issues related to inclusive politics in Nepal,
b. Build strategic partnerships with like-minded individuals and institutions in and outside of Nepal
c. Inform and engage all Nepalese, with a particular focus on marginalized communities, in the drafting of the new constitution in Nepal,
d. Identify linkages and support from national and international organizations to enhance the capacity of Constitution Assembly members from marginalized communities,
e. Advocate for genuine consultations with Nepalese of all caste, creed, class, religion, and gender in the drafting of the new constitution to establish an inclusive democracy for all peoples.

The meeting also decided to hold an another interaction program some time very soon.
